1. Acceptance of Terms

By creating an account or using Apptonic (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Apptonic is operated by the Apptonic team (“we,” “our,” or “us”).

2. Description of Service

Apptonic is a market intelligence platform that aggregates publicly available data from app stores, social media platforms, and ad libraries to provide analytics, trend detection, and AI-powered insights for app founders and marketers.

3. Accounts and Eligibility

• You must be at least 18 years old to use Apptonic.
• You are responsible for maintaining the security of your account credentials.
• Each subscription plan allows a limited number of simultaneous active devices. Sharing accounts across teams beyond your plan's seat limit is not permitted.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

• Apptonic offers Free and Premium plans. Plan details and pricing are available on the pricing page.
• Subscriptions are billed monthly or annually depending on your selected plan.
• Credits are allocated at the start of each billing cycle and do not roll over.
• All payments are processed by Stripe via Clerk Billing. By subscribing, you authorise recurring charges to your payment method.
• Refunds are provided at our discretion. Contact us within 7 days of a charge if you believe it was made in error.

5. Acceptable Use

You agree not to:

• Use the Service to scrape, copy, or redistribute Apptonic's dataset in bulk.
• Attempt to reverse-engineer, decompile, or access non-public APIs or infrastructure.
• Use the Service to build a competing product without our written consent.
• Circumvent credit limits, device limits, or other usage controls.
• Upload, share, or process any content that is illegal, harmful, or violates third-party rights.

6. Intellectual Property

All software, design, algorithms, and compiled datasets in Apptonic are the property of Apptonic or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes. Nothing in these terms transfers ownership of any intellectual property to you.

7. Third-Party Data

Apptonic surfaces publicly available data from third-party platforms (TikTok, Instagram, Meta Ads Library, App Store, Google Play). We do not guarantee the accuracy, completeness, or timeliness of this data. Use of insights derived from Apptonic is at your own risk.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Apptonic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the Service. Our total liability in any matter is limited to the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these terms at any time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after that date constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the jurisdiction in which Apptonic is registered, without regard to conflict of law principles.
